General Terms and Conditions of Monadjem GmbH for online orders via rugsociete.com.

1. Scope

The following GTC apply to all orders placed through our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity. A business is a natural or legal person or a legal partnership that acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

2. Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer but an non-binding online catalogue.

By clicking the order button, you submit a binding order for the goods contained in the shopping cart. Immediately after submitting the order, you will receive an automatic order confirmation by email. This does not yet constitute acceptance of your offer but merely informs you of the receipt of your order.

The purchase contract is only concluded when we confirm the dispatch of the goods to you (dispatch confirmation) or when the goods are actually dispatched to you — whichever occurs first.

Our offers are always subject to availability. Should an item unexpectedly not be available, we reserve the right not to accept your order. In this case, we will inform you promptly and refund any payments already made without delay.

3. Prices and Payment

All prices stated in our online shop are total prices including statutory VAT. Any additional delivery and shipping costs will be shown separately in the respective product description and during the ordering process.

Payment is made via our payment service provider Stripe. You can pay by credit card (Visa, Mastercard, American Express) or other payment methods displayed at checkout. Card payments use encryption solutions to ensure security when shopping.

4. Delivery Terms

Delivery is made to the delivery address specified by the customer in the ordering process. Shipping within the European Union, Switzerland, the United Kingdom, and Norway is free of charge. For deliveries to other countries, please contact us.

Expected delivery times: Germany 3–5 working days, EU 5–10 working days, Switzerland/UK/Norway 5–10 working days.

If the customer acts as a consumer, the risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods to the customer or an authorised recipient. If the customer acts as a business, the risk passes to the customer upon handover to the shipping company.

5. Statutory Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, other than the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Monadjem GmbH, Brooktorkai 8, 20457 Hamburg, Germany, Email: info@rugsociete.com, Phone: +49 40 330764) by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory.

To comply with the withdrawal period, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied proof of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is deemed to have been observed if you send back the goods before the expiry of the period of fourteen days.

You shall bear the direct cost of returning the goods. When using our returns service, the return shipping costs are free of charge for you.

You must pay for any loss in value of the goods only if such loss in value is attributable to handling of the goods that is not necessary for examining their condition, characteristics and functioning.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose manufacture an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

6. 30-Day Voluntary Return Policy

For all rugs you purchase from RUGSOCIÉTÉ, we grant you a voluntary return right in addition to the statutory right of withdrawal. The period for exercising the voluntary return right begins at the end of the statutory withdrawal period and ends 30 days after receipt of the goods. Timely dispatch is sufficient to comply with the deadline.

A prerequisite for exercising the voluntary return right is that you return the goods in their original condition, intact and undamaged, in the original or comparable packaging.

If you wish to use our returns service, please contact our customer service by email (info@rugsociete.com) or by phone (+49 40 330764). You will then receive the return information by email.

Return shipping with our returns service is free of charge within the EU.

Refunds will always be made in the same way you made the payment.

Your statutory right of withdrawal is not affected by compliance with our voluntary return policy rules and remains in force independently. Until the expiry of the statutory withdrawal period, only the statutory conditions set out there apply.

7. Conditions for Returns and Refunds

Nothing in these provisions on returns shall restrict or limit your statutory right of withdrawal.

A prerequisite for a full refund is that the goods are returned in their original condition. A returned product must be clean, undamaged and well packaged, in the original packaging or equivalent packaging.

If the goods are not returned in appropriate condition, we reserve the right to claim compensation for loss of value.

Refunds will generally be made via the same payment method the customer chose for the original order.

8. Statutory Warranty

Our products are subject to the statutory warranty in accordance with applicable consumer protection regulations. We are obliged to deliver goods to you in the agreed quality as described in the respective product description.

The warranty applies exclusively to product defects that already existed at the time of delivery. Damage caused by improper use (e.g. accidents, incorrect handling, failure to observe care instructions) or normal wear and tear is excluded.

Warranty claims must be asserted within the statutory limitation period of two years from receipt of the goods. Please contact our customer service with photos of the defect for this purpose.

Please note that with handmade products, individual, minor variations in colour, pattern or size may occur — these are characteristic of handcrafted work and do not constitute a defect. Similarly, with vintage or antique rugs, usual signs of wear or characteristics listed in the product description are not considered defects.

9. Transport Damage

We are responsible for damage during shipping until delivery to you or an authorised recipient upon first delivery.

Please report visible damage upon delivery to the carrier immediately and inform us promptly at info@rugsociete.com, so that we can assist you with the damage report.

10. Retention of Title

The goods remain our property until full payment has been made.

11. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

Should any provision of these General Terms and Conditions prove to be invalid, the validity of the remaining provisions shall not be affected.

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you shall be our place of business in Hamburg.
